A Novated Lease is an arrangement between an employee, the employer and a Lease financier which enables the employee to lease a car of his or her choice and still enjoy the benefits of a company car.

Under the arrangement, an employee leases a motor vehicle from the Lease Financier using a standard finance lease agreement.  The employee then sub-leases the vehicle to the employer through a sub-lease agreement. A novation agreement is entered into between the employer, employee and the lease financier under which the employee’s obligation to pay the lease rentals under the finance lease is transferred to the employer for the term of the novation agreement.  Therefore the employer pays the lease rentals directly to the Lease Financier.

In the event of the employee leaving the employment the sub-lease agreement and the novation agreement immediately expire and the employer no longer has any obligations under the agreement.  In this way the obligation to pay the lease rentals under the finance lease revert to the employee.  The employee retains possession of the vehicle, as leasee, until expiry of the finance lease.
